- IDENTIFICATION OF THE OPERATOR
These Terms and Conditions govern the contractual relationship between Bc. Marek Kotyza, Business ID (IČO): 75084431, registered office Matějkova 1935/12, 190 00 Prague, Czech Republic, email info@tourguidematch.com, website whattodoinczechia.com, hereinafter referred to as the “Provider”, and the customer, hereinafter referred to as the “Customer”. - SCOPE OF SERVICES
The Provider operates an online platform offering own services and products including digital self-guided tours and experiences, as well as third-party services including tours, tickets and activities provided by external suppliers. The Provider may act as a direct service provider, reseller, intermediary or distributor. - CONTRACTUAL RELATIONSHIP
3.1 For own products, a contract is concluded between the Provider and the Customer.
3.2 For third-party services, a contract is concluded between the Customer and the respective supplier.
3.3 The Provider acts solely as an intermediary and is not responsible for the execution of third-party services. The identity of the actual supplier is displayed on the product page or in the booking confirmation. The Customer acknowledges that the Provider may not be the actual service provider and that legal responsibility for service delivery lies with the supplier unless explicitly stated otherwise. - BOOKINGS AND PAYMENT
All bookings are made online and full payment is required at the time of booking. The Customer receives a confirmation email which serves as a valid voucher. All bookings are subject to final availability confirmation. In rare cases of technical error, overbooking or supplier-side issues, the Provider reserves the right to cancel the booking, offer an alternative or issue a full refund. A booking confirmation, voucher issuance or delivery of digital access constitutes valid proof of service delivery. The Provider may use system logs, access records, QR code scans or activation data as evidence in case of disputes or chargebacks. The Customer is responsible for providing a correct and valid email address and for checking spam or junk folders. The Provider is not responsible for non-delivery caused by incorrect email address, spam filtering or technical issues on the Customer’s side. - PRICING AND TAXATION
Prices are final at checkout and may include commissions, service fees and margins. Prices may differ from supplier base prices and may vary depending on distribution channel, bundled services or supplier pricing strategies. The Customer acknowledges that price differences across platforms do not constitute grounds for refund or complaint. The Provider is not a VAT payer. Where applicable, prices may include VAT, local taxes or other charges applied by third-party suppliers. The Customer acknowledges that the Provider does not act as a tax collector and that tax obligations are fulfilled by the respective supplier where applicable. The Customer agrees to the final displayed price regardless of internal price structure. - CANCELLATION POLICY
Unless stated otherwise, free cancellation is available up to 24 hours before the activity start time. After that, the booking is non-refundable. In case of no-show or late arrival, no refund will be provided and the service may be forfeited entirely. In case of partial use of the service, no refund, full or partial, shall be provided. Any use of the service including entry, activation of digital content or partial participation is considered full consumption of the service. Vouchers are valid only for the date and time specified or within the validity period stated on the voucher. Expired vouchers cannot be refunded or rescheduled unless explicitly agreed. Third-party services may be subject to stricter cancellation conditions and supplier policies may override the general policy. - CHANGES AND AVAILABILITY
The Provider or supplier may change schedules, modify content or cancel services. In such cases, the Customer may receive an alternative service or a refund at the Provider’s discretion or according to supplier policy. All times and schedules are stated in the local time of the destination and the Customer is responsible for verifying the correct time and arriving accordingly. - LIABILITY LIMITATION
To the maximum extent permitted by law, the Provider shall not be liable for injury, illness, death, property damage, loss, delays, cancellations or any actions or omissions of third-party suppliers. Total liability of the Provider shall not exceed the amount paid for the booking. In the case of third-party services, the Provider’s financial liability is limited to the amount actually received from the Customer and the Provider is not obligated to compensate beyond what is recoverable from the supplier. In the event of supplier failure including non-performance, last-minute cancellation or closure of operations, the Provider will make reasonable efforts to assist the Customer but does not guarantee compensation and any refund is subject to supplier cooperation and policies. - THIRD-PARTY SERVICES DISCLAIMER
The Provider does not control third-party services, does not guarantee their quality and is not responsible for their execution. All complaints must be directed to the supplier. - CUSTOMER RESPONSIBILITY
The Customer must provide accurate information, follow instructions and comply with applicable laws and safety rules. The Customer making the booking acts on behalf of all participants and is responsible for informing all participants about the booking conditions. - DIGITAL PRODUCTS AND ACCESS
Digital products may be delivered via web applications, QR codes or access codes. Access may be time-limited and one purchase is intended for one user. Sharing or reselling is prohibited. A digital product is considered delivered at the moment when access is granted via link, QR code or access code or when the Customer first opens or activates the content. From this moment, the service is deemed fully performed. By purchasing and accessing a digital product, the Customer explicitly requests immediate delivery and acknowledges that the service is fully performed upon access. The Customer therefore waives the right to withdraw from the contract once access has been granted. The Provider reserves the right to monitor usage and detect misuse or unauthorized sharing. In case of violation, access may be immediately revoked without refund. - INTELLECTUAL PROPERTY
All content on the platform is protected by intellectual property rights and any unauthorized use is prohibited. - AFFILIATE AND DISTRIBUTION
The Provider may distribute its products through third parties, allow third parties to resell its products and resell third-party services. Third-party partners act independently and are not agents of the Provider unless explicitly stated. The Provider is not liable for partner conduct or third-party marketing claims. Products are non-transferable and may not be resold without prior written consent. The Provider reserves the right to cancel suspicious bookings, refuse service, block access or request identity or payment verification. This includes suspicious payment activity, mismatched customer data or unusual booking behavior. In case of unjustified chargebacks, the Provider reserves the right to dispute the chargeback, provide evidence and recover damages. - FORCE MAJEURE
The Provider shall not be liable for failure or delay in performance caused by events beyond reasonable control including natural disasters, pandemics, government restrictions, strikes, technical failures, war, armed conflicts, terrorist attacks, civil unrest, political instability or travel restrictions. In such cases, services may be modified, postponed or cancelled and refunds are subject to supplier policies or Provider discretion. - COMPLAINTS AND CLAIMS
Any complaints must be submitted via email to info@tourguidematch.com including booking reference and description of the issue. The Provider will confirm receipt within 24 to 48 hours and assess the complaint within a reasonable timeframe. Standard resolution time is typically 7 to 30 days depending on complexity and supplier involvement. For third-party services, complaints may be forwarded to the supplier and resolution depends on supplier cooperation. - REFUNDS PROCESSING
If a refund is approved, it will be processed within 7 to 12 business days using the original payment method unless agreed otherwise. The Provider is not responsible for delays caused by banks, payment providers or third-party suppliers. - CUSTOMER SUPPORT
Customer support is available via email at info@tourguidematch.com with a typical response time of 24 to 48 hours. - TECHNICAL DEPENDENCY DISCLAIMER
The Provider relies on third-party systems including booking platforms, payment gateways and applications. The Provider is not liable for system outages, technical errors or temporary unavailability. - SERVICE DEFINITION AND LIMITATIONS
The Customer acknowledges that self-guided products are designed as independent exploration tools and do not include a live guide or personal assistance unless explicitly stated. Entry tickets are included only if clearly specified in the product description. The experience may vary depending on individual preferences, timing and external conditions. The Provider does not guarantee a specific personal experience or subjective satisfaction. - LANGUAGE
These Terms are drafted in English. In case of translation, the English version shall prevail. - SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain valid and enforceable and the invalid provision shall be replaced with one reflecting the original intent as closely as possible. - ENTIRE AGREEMENT
These Terms constitute the entire agreement between the Provider and the Customer and supersede any prior communication, representation or agreement. - NO WAIVER
Failure by the Provider to enforce any provision shall not be considered a waiver of such provision. - ASSIGNMENT
The Provider reserves the right to assign or transfer its rights and obligations under these Terms to a third party. - FINAL PROVISIONS
These Terms are governed by the laws of the Czech Republic and disputes shall be resolved by Czech courts. By completing a booking, the Customer confirms that they have read, understood and agreed to these Terms and Conditions.
